In case of land surveying or specification of location of borders your land plot crosses borders of the adjacent land plot or is completely located in borders of other land plot, then the problem which now has arisen can be resolved, having addressed to the Federal Registration Service of Tatarstan.
Management of the Federal Registration Service in the Republic of Tatarstan on the basis of your address will eliminate this crossing (imposing) by removal of the "disturbing" land plot from the state register. It is possible in case it is about the land plot, the information about which owner is absent in the Unified state register of the real estate and which state cadastral registration is carried out till March 1, 2008. This situation is established by the federal law "About the State Registration of the Real Estate" which has come into force since January, 2017. In total the Federal Registration Service of Tatarstan during operation of the law has struck more than one thousand land plots off the state register.
In more detail about when it is possible to strike the land plot off the cadastral registration, we were told by the deputy chief of department of maintaining Unified state register of the real estate and improvement of quality of data of Unified state register of the real estate of Management of the Federal Registration Service in the Republic of Tatarstan Sergey Milyutin:
- It occurs in the following cases: if data on the land plot contain in the Unified State Register of the Real Estate, but the rights for it aren't registered. In this case a request in public authorities, local governments about existence of documents of title and the bases for differentiation of the property right, concerning the land plot is sent. If within 3 months reply to the request doesn't arrive or the notice of lack of such documents arrives, the land plot is struck off the cadastral registration.
If data on the land plot contain in Unified state register of the real estate, the rights for it which aren't registered, but on the site the real estate object is located, in this case the notice that if within 6 months documents for carrying out registration of the rights concerning the land plot occupied with a real estate object aren't submitted, such land plot will be struck off the cadastral registration is sent to the owner of a real estate object;
If in Unified state register of the real estate there are data on the initial land plot with the registered rights in such situation the notice that if within 6 months documents for carrying out registration of the rights concerning the educated land plot aren't submitted, such land plot will be struck off the register is sent to the owner of the initial land plot.
Also Sergey Milyutin has added that since last year Management of the Federal Registration Service in the Republic of Tatarstan independently reveals such land plots and carries out their removal from the state cadastral registration. It allows to eliminate a large number of crossings of the land plots, to limit time of citizens for clarification of the reasons of such imposings, and, above all that is important, this service allows to save means of citizens which could be spent for elimination of such crossings (imposings).
