On a land leased from the state, you can first build a house, and then buy the land. How to properly lease land, where to start the procedure for acquiring and registering a land plot that is in state or municipal ownership, as well as what are the nuances of drawing up an agreement - Artur Galiev, First Deputy Minister of Land and Property of the Republic, spoke about this.

- Artur Irekovich, to begin with, please explain under what conditions and for how long you can rent land?

- Individuals and legal entities can lease land from the state for different periods and for different purposes. The term of the lease depends on the intended use of the site. In particular, for the construction and reconstruction of buildings and structures, the lease period is from three to ten years. For the placement of linear facilities, as well as in the case of providing the owner of a building, structure located on such a land plot, for rent - up to forty-nine years. For the integrated development of the territory by a legal entity, the lease is possible for the duration of the agreement on the integrated development of the territory, for the completion of construction - up to three years, for work related to the use of subsoil, the lease period should not exceed two years from the date of expiration of the license, and for agricultural production - from three to forty-nine years.

- How is the price for the leased area formed?

– The rent for land plots provided without tenders is determined by the Decree of the Cabinet of Ministers of the Republic of Tatarstan No. 74 “On rent for land”. The initial price of the subject of the auction is set according to the results of the market valuation or in the amount of at least one and a half percent of the cadastral value of the site, if the results of the state cadastral valuation are approved no earlier than five years before the date of the decision to hold the auction.

  Is it easy to find a plot to rent?

– Information about land plots is contained on the public cadastral map of Russia or on the portal of Federal service of state registration, cadastre and cartography. Also on the public cadastral map of Russia there is information on free land plots for housing construction (“Land for construction”) and recreation facilities (“Land plots for outdoor recreation and recreation facilities”).

  – How to get land for rent?

– State or municipal land is leased based on the results of auctions. They have been held in electronic form since March 1 of the current year. Notice of their conduct is published at least thirty days before the day of the auction. The portal www.torgi.gov.ru is defined as the official site. In order to acquire a land plot on the right of lease, it is necessary to apply with an application to the body authorized to dispose of the land plot. Preparation of a plot location scheme on the cadastral plan of the territory in the form of an electronic document is possible using the official website of the Federal Service of State Registration, Cadastre and Cartography through the personal account of the public services portal.

  Is it possible to redeem the leased land?

  - The land leased from the state can be redeemed in the future. The owners of buildings, structures located on such land plots, whether they are citizens or legal entities, have the exclusive right to acquire it in ownership or for rent. The cost of the plot is determined in accordance with the Decree of the Cabinet of Ministers of the Republic of Tatarstan dated October 3, 2012 “On the sale of land plots owned by the Republic of Tatarstan or state ownership of which is not demarcated, on which buildings, structures are located, to the owners of such buildings, structures or premises in them in cases stipulated by Article 3920 of the Land Code of the Russian Federation”. To acquire a land plot, it is necessary to apply with an application to the body authorized to dispose of the land plot. I note that from August 20, 2022, the redemption value has been reduced from 100 percent of the cadastral value to 25 percent in urban districts and 12.5 percent in municipal districts of the republic.
