Changes for expansion of property support of subjects of small and average business are made to separate acts of legislation
Vladimir Putin has signed the Federal law of July, 3, 2018 No. 185-FZ "About introduction of amendments to separate acts of the Russian Federation for expansion of property support of subjects of small and average business", accepted by the State Duma on June 21, 2018 and is approved by the Federation Council on June 27, 2018.
The federal law provides establishment of the termless right of repayment of the rented state and municipal property and creation of an opportunity for use of the land plots when rendering property support to subjects of small and average business.
According to the federal law federal executive authorities, executive authorities of territorial subjects of the Russian Federation, local governments approve lists of the state property and municipal property, free from the rights of the third parties (except for the right of economic maintaining, the right of operational management and also property rights of subjects of small and average business). Such property is used for granting it in possession and (or) in use on a long-term basis (including at the preferential rates of the rent) to the subjects of small and average business and the organizations forming infrastructure of support of subjects of small and average business and also can be aloof on a paid basis in the property of subjects of small and average business. At the same time the state and municipal property fixed on the right of economic maintaining or operational management for state or municipal unitary enterprise on the right of operational management behind the public or municipal authority, can be included in the specified lists of the state and municipal property with the consent of the public authority of the Russian Federation, public authority of the territorial subject of the Russian Federation or local government authorized for coordination of the transaction with the corresponding property for granting such property in possession and (or) in use to the subjects of small and average business and the organizations forming infrastructure of support of subjects of small and average business.
The subjects of small and average business renting the land plots included in the specified lists of the state and municipal property having no right to transfer the rights and obligations for the lease contract of the land plot to the third party, including to pawn the rent rights of the land plot and to bring them as a contribution to authorized capital of economic association or society or a share to production cooperative and also to transfer the leased land plot to sublease.
