Change of a procedure of payments of cost of the land during its redistribution
The resolution of the DCabinet of the Republic of Tatarstan of August 3, 2018 No. 638 are made changes to the Order according to which the amount of a payment decides as a difference between the cadastral cost of the land plot which is subject to transfer to a private property after increase in the area of the land plot which is in a private property as a result of redistribution on the land plots which are owned by the Republic of Tatarstan, lands or the land plots on which state ownership isn't differentiated, and the cadastral cost of the land plot which is in a private property on the date of filing of application about redistribution.
The procedure of redistribution of the lands which are in the state or municipal ownership and the land plots which are in a private property happens according to standards of the land legislation which regulate the specified question. This procedure is allowed in the following cases:
- at redistribution of lands in borders of the built-up territory concerning which the contract on development of the built-up territory, for reduction of borders of the land plots in compliance is signed with the approved boundary-setting plan;
- at redistribution of lands for reduction of borders of the land plots in compliance with the approved boundary-setting plan for an exception of crossings of the operating borders, of imposing of borders at each other and their distortions, provided that land area, being in a private property, increases as a result of this redistribution no more than to the established extreme maximum sizes of the land plots;
- redistribution of the lands which are in the state or municipal ownership and the land plots which are owned by citizens and intended for maintaining personal subsidiary farm, truck farming, gardening, small-scale farming and construction, individual housing construction provided that land area, the owned citizens, increases as a result of this redistribution no more than to the established extreme maximum sizes of the land plots;
- the land plots are formed for placement of the capital construction projects provided by article 49 of the Land Code of the Russian Federation including for seizure of land for the state or municipal needs.
Redistribution of lands is carried out on the basis of the agreement.
This service is provided by local governments concerning the land plots which are in municipal property and the land plots on which state ownership isn't differentiated.
The service is free. However the citizen has to pay the redemption cost of the "attached" earth or the parts of the land plot which are in the state or municipal ownership
