On December 31, 2012 a number of new standards of the town-planning legislation came into force.
Clause 4 of the Art. 9 of Town-planning codes of the Russian Federation establishes that public authorities, local governments are not allowed to make decisions (except for the cases provided by federal laws) about reservation of lands, about withdrawal, including by repayment, the ground areas for the state or municipal needs, about transfer of lands from one category into another, about granting of ground areas in state or municipal ownership in order to locate objects of federal value, objects of regional value, objects of local value if location of such objects is not provided by documents of territorial planning of the Russian Federation, documents of territorial planning of the subject of the Russian Federation, documents of territorial planning of municipalities, and about transfer of lands from one category into another for the purposes not connected with location of objects of federal value, objects of regional value, objects of local value of municipal areas in case of the absence of the general plan of the city district or the settlement (the scheme of territorial planning of the municipal area in case of transfer of the lands located in unincorporated areas from one category into another).
It is established by the federal law on 30.12.2012 No. 289-FL "On modification of the Town-planning code of the Russian Federation and separate acts of the Russian Federation" that the regulations of Clause 4 of Art. 9 of the Town-planning code of the Russian Federation are not applied to the corresponding decisions in order to locate objects of local value of settlements in city territories till March 31, 2013, in rural territories till December 31, 2013. The law also removes terms after which in the case of absence of land usage and building rules sites for construction from the lands in the state or municipal ownership are not provided. With respect to municipal areas - till June 30, 2013, to city settlements and districts - till December 31, 2013, to rural settlements - till June 1, 2014.
