Anti-corruption legal education: Control over the correspondence of expenses of state and municipal employees to their income

The Institute for Control over the Expenses of Civil Servants was put into effect on January 1, 2013 by the Federal Law of 03.12.2012 No. 230-ФЗ On Control over the Compliance of Expenses of Persons Holding Public Positions and Other Persons with Their Incomes.

In the event that a civil servant or members of his family (spouse, spouse, minor children) during the reporting year spend on the transaction (transactions) for the acquisition of real estate, vehicles, securities an amount exceeding the total income of this person and his family members for In the last three years preceding the reporting period, a decision has been made with regard to the civil servant to exercise control over expenditures.

The law establishes the procedure for exercising control over the expenses of civil servants, as well as the grounds for applying to the income of the state of property, in respect of which no information has been provided confirming its acquisition with legally received income.

Information on expenses and sources of funds received annually for each transaction is provided in relation to:

real estate objects (land plots, apartments, houses, etc.);

vehicles (car, motorcycle, boat, boat, plane, helicopter, etc.);

securities (participatory interest, shares in the authorized (share) capital of organizations);

in cases where the transaction was made during the calendar year preceding the year of submission of information on income, and the total amount of such transaction (transactions) exceeds the total family income for the last three years preceding the reporting period

The basis for making a decision on exercising control over expenses is sufficient information that a person, his / her spouse or minor children has made a transaction to acquire property in an amount exceeding income for the last three years.

This information in writing can be submitted by law enforcement agencies, other state bodies, local self-government bodies, employees of departments for the prevention of corruption offenses, officials of the Bank of Russia, the Pension Fund of the Russian Federation, Social insurance fund, Compulsory health insurance fund, governing bodies of political parties and all-Russian public associations, the Public Chamber, the media.
