Anti-corruption legal education: "Conditions entailing the need for a citizen - a former civil servant to obtain the consent of the commission on compliance with the requirements for official conduct and settlement of conflicts of interest"

The conditions entailing the extension to the citizen of the obligation to obtain the consent of the commission for compliance with the requirements for official conduct of civil servants and the settlement of conflicts of interest (hereinafter - the commission) are:

finding a position that a citizen was filling, in the list of positions, the replacement of which is associated with corruption risks, when filling which civil servants are required to provide information about their income, expenses, property and property obligations, as well as information about income, expenses, property and property obligations of their spouses and minor children;

the official (official) duties of a citizen - a former civil servant included certain functions of state, municipal (administrative) management of the organization in which he is employed;

less than two years have passed since the date of dismissal of a citizen from public service;

conclusion of an employment contract, regardless of the amount of wages or the conclusion of a civil contract (civil contracts), the cost of performing work (rendering services) under which (which) is more than one hundred thousand rubles during a month.

The decision to obtain the consent of the commission is based on the totality of the above conditions.

The period during which the restrictions established by Article 12 of the Federal Law "On Combating Corruption" are in effect starts from the day of dismissal from public service and ends after two years.

If, within two years from the date of dismissal from the public service, a citizen is employed repeatedly in various organizations, the corresponding restrictions apply to each case of his employment.

The restrictions provided for in Article 12 of the Federal Law "On Combating Corruption" apply to a citizen, regardless of the grounds for his dismissal from public service.
