A law aimed at improving the legal framework for combating corruption was signed

Federal Law No. 16-ФЗ of February 24, 2021 "On Amendments to Articles 201 and 285 of the Criminal Code of the Russian Federation" (hereinafter referred to as the Federal Law) expanded the list provided for in paragraph 1 of the Notes to Article 285 of the Criminal Code of the Russian Federation (hereinafter referred to as the Code) persons who are recognized as officials for the purposes of Chapter 30 "Crimes against state power, the interests of public service and service in local government" of the Code.

This list includes persons performing organizational and administrative or administrative and economic functions in business entities, in the supreme governing body of which the Russian Federation, a constituent entity of the Russian Federation or a municipal formation has the right, directly or indirectly (through persons under their control) to dispose of more than 50 percent of the votes. or in which the Russian Federation, a constituent entity of the Russian Federation or a municipality has the right to appoint (elect) a sole executive body and (or) more than 50 percent of the composition of a collegial management body, in joint-stock companies in respect of which the special right to participate of the Russian Federation is used, constituent entities of the Russian Federation Federation or municipalities in the management of such joint stock companies ("golden share"), as well as in public companies and state extra-budgetary funds

 In addition, the Federal Law introduces a corresponding amendment to paragraph 1 of the Notes to Article 201 of the Code, which determines which persons are recognized as performing managerial functions in a commercial or other organization, as well as in a non-profit organization that is not a state body, local self-government body, state or municipal institution.
