The bill on "garage amnesty" passed the third reading
On March 23, 2021, the State Duma of the Russian Federation passed the third reading of the draft federal law No. 1076374-7 "On Amendments to Certain Legislative Acts of the Russian Federation" (on the "garage amnesty"), hereinafter referred to as the draft law).
The bill provides that until September 1, 2026, a citizen using a garage, which is an object of capital construction and erected before the entry into force of the Urban Planning Code of the Russian Federation, has the right to grant free ownership of a land plot in state or municipal ownership on which he located, in particular, if the land plot for the garage was provided to a citizen or transferred to him by any organization (including with which this citizen was in labor or other relations) or otherwise allocated to him or the right to use such a land plot arose from citizen for other reasons.
It is specified that persons with disabilities have an extraordinary right to provide land plots in state or municipal ownership for the construction of garages near the residence of persons with disabilities or to use land or land plots in state or municipal ownership for the construction of garages that are non-capital structures, or parking of technical or other vehicles for people with disabilities near their place of residence without the provision of land plots and the establishment of easements, public easements.
State registration of ownership of the land plot on which the garage is located, erected before the date of entry into force of the Urban Planning Code of Russian Federation, and which is provided to the citizen free of charge, is carried out simultaneously with the state cadastral registration of such a garage (if earlier its state cadastral registration was not was carried out) and state registration of the ownership right of this citizen to such a garage, which are carried out at the request of the executive body of state power or local government body that provided this citizen with the specified land plot.
The amendments are scheduled to enter into force on September 1, 2021.
