Federal Law No. 79-FZ of April 5, 2021 "On Amendments to Certain Legislative Acts of the Russian Federation" (hereinafter referred to as the Federal Law) establishes that, by September 1, 2026, a citizen using a garage that is an object of capital construction and erected before the date of introduction into force of the Urban Planning Code of the Russian Federation, has the right to grant free ownership of a land plot that is in state or municipal ownership, on which it is located, in particular, if the land plot for the garage was provided to a citizen or transferred to him by any organization (including with which this citizen was in labor or other relations) or otherwise allocated to him or the right to use such a land plot arose from a citizen for other reasons.
Along with this, the Federal Law determines the list of documents required to provide citizens with ownership of land plots and the grounds for refusing to provide them.
In particular, it is envisaged that the decision on the preliminary approval of the provision of a land plot or the provision of a land plot must be refused if the corresponding garage is recognized as an unauthorized building subject to demolition in a judicial or other procedure prescribed by law.
In addition, it is established that citizens using garages and garage owners have the right to use land plots intended for general use for passage and passage to garages freely and without charging a fee.
