The head of the Ministry of Land Property of the Republic of Tatarstan reported on the work carried out on the inventory of real estate objects

The Minister of Land and Property of the Republic of Tatarstan Fanil Agliullin reported on the progress of the inventory of real estate objects to which there are no registered rights at the republican meeting in the House of Government of the Republic of Tatarstan.

The meeting was held by videoconference with all municipal districts by the President of the Republic of Tatarstan Rustam Minnikhanov. The meeting was also attended by the Prime Minister of Tatarstan Alexey Pesoshin.

In total, about 850 thousand “problem” real estate objects were identified. To date, about 800 thousand objects have been surveyed, which is 94% of the total.

Fanil Agliullin noted that the survey and collection of additional information from 39 municipalities have been completed. As part of the inventory, about 70 thousand objects were identified, the rights to which arose earlier, namely, before the date of the entry into force of the Federal Law on State Registration of Rights to Real Estate and Transactions with It (dated July 21, 1997 No. 122-ФЗ).

The minister outlined several recent legislative changes. On the initiative of the Republic of Tatarstan, the payment of the state duty was canceled (for individuals 350 rubles for a land plot and 2000 rubles for a capital construction object) for registering previously arisen rights.

In December 2020, Federal Law No. 218-ФЗ on state registration of real estate was supplemented with Article 69.1, according to which the executive authorities and local governments are empowered to take measures to identify the owners of previously registered real estate objects; Carrying out measures to ensure that information about the copyright holders of previously registered real estate objects is entered into the United state register of real estate; making a decision to identify the owner of the previously registered real estate object; sending to the registration authority of the application for entering into the United state register of real estate information about the copyright holder of the previously registered real estate object.

The authorized bodies are empowered to send inquiries and receive information about the rightholders of previously registered real estate objects contained in documents held in the archives of such bodies as the Ministry of Internal Affairs, the Tax Service, the Civil Registry Office, the Notary. In this regard, the necessary changes have been made to the Fundamentals of the Legislation of the Russian Federation on Notaries (dated 11.02.1993 No. 4462-1), the Federal Law "On acts of civil status" (dated 15.11.1997 No. 143-ФЗ) and the Federal Law "On the Police" (dated 07.02.2011 No. 3-ФЗ) in terms of providing information requested as part of measures to identify the rightholders of previously registered real estate objects. This rule comes into force on June 29 of the current year (upon the expiration of 180 days after the day of official publication).

The Minister noted that this law applies only to real estate objects registered in the United state register of real estate, and urged his colleagues to carefully familiarize themselves with the innovations in the legislation and take full advantage of this opportunity.

Fanil Agliullin also spoke about the experiment to create a single information resource on land and real estate, in which the Republic of Tatarstan participates among four regions (Irkutsk Oblast, Krasnodar and Perm Territories). The success of the experiment directly depends on the completeness and quality of the information contained in the Unified State Register of Real Estate, he stressed.

In this regard, the Government of the Republic of Tatarstan and the Office of Rosreestr approved the Roadmap of the Republic of Tatarstan for the implementation of the activities of the Rosreestr project "Filling the Unified State Register of Real Estate with the Necessary Information" for 2021 and subsequent years. Currently, the Roadmap is being updated in terms of its addition with measures for three pilot municipal districts (Atninsky, Zelenodolsky, Pestrechinsky districts) of the republic participating in the experiment.

As the head of the Ministry of Land Property of the Republic of Tatarstan noted, this project made it possible to expand Tatarstan's access to federal sites, which allow solving urgent problematic issues in direct dialogue with federal executive authorities. And questions of interest have already been sent to Rosreestr (Moscow), which can only be resolved within the framework of federal legislation.
