Anti-corruption legal education: Conflict of interests in the civil service and the procedure for its settlement (part 4)

11 June 2021, Friday

Conflict of interest related to performing other paid work.

Description of the situation:

A civil servant, his relatives or other persons with whom the personal interest of a civil servant is associated, performs paid work in an organization that is a parent, subsidiary, or otherwise affiliated with another organization in respect of which the civil servant performs certain functions of public administration.

Prevention and control measures:

When giving the employer's representative prior notice of other paid work, the civil servant should fully describe how the organization in which he intends to perform other paid work is related to the organizations in respect of which he performs certain functions of government. At the same time, it is recommended to refuse to perform other paid work in parent, subsidiary and otherwise affiliated organizations.

If at the time of the commencement of the performance of certain functions of state administration in relation to the organization, the relatives of the civil servant have already performed paid work in the affiliated organization, it is necessary to notify the personal interest of the employer's representative and immediate superior in writing.

The employer's representative is recommended to suspend the civil servant from performing official (official) duties in relation to an organization that is a parent, subsidiary or otherwise affiliated with the organization in which the civil servant performs other paid work.
