Cultural organizations can conclude property lease agreements without holding tenders and auctions
September 9, 2021 Chairman of the Government of the Russian Federation M.V. Mishustin signed decree No. 1529 "On approval of the Rules for concluding lease agreements without tenders or auctions in relation to state or municipal property assigned to the right of economic management or operational management of state or municipal cultural organizations."
The Resolution established that cultural organizations in which property is under economic control or operational management may conclude lease agreements for such property without holding tenders and auctions in the following cases:
with catering organizations - in order to create the necessary conditions for organizing catering for visitors and workers of cultural organizations;
with legal entities and individual entrepreneurs carrying out retail trade of souvenir, publishing and audiovisual products corresponding to the objectives of the cultural organization.
The rules stipulate the procedure for concluding such agreements, which provides for the placement of information about property by a cultural organization on its official website on the Internet and consideration of applications received.
In addition, the rules additionally stipulate that an essential condition of the contract is the prohibition on the sublease of property and its use for purposes not provided for by the legislation on the protection of competition.
