Anti-corruption legal education: Conflict of interests in the public civil service and the procedure for its settlement (part 11)

26 November 2021, Friday

Typical situation:

Conflict of Interest in Receiving Gifts and Services.

Description of the situation:

A civil servant receives gifts from his immediate subordinate.

Prevention and control measures:

The civil servant is advised not to accept gifts from direct reports, regardless of their value and reason for giving.

You should be especially strict about receiving regular gifts from one donor.

The representative of the employer, who became aware of the receipt of gifts by the civil servant from direct reports, should indicate to the civil servant that such a gift can be considered as received in connection with the performance of official duties, and therefore such a practice may entail a conflict of interest, and also recommend a government official to return the received gift to the donor in order to prevent a conflict of interest.
