More than 8,000 Tatarstan residents have registered their earlier rights to real estate

Department of Federal service of state registration, cadastre and cartography of the Republic of Tatarstan summed up the interim results of the implementation of the Federal Law, which establishes the procedure for identifying the right holders of previously recorded real estate objects.

Recall that this Law (No. 518-ФЗ) entered into force on June 29, 2021. We are talking about objects, the rights to which arose before January 31, 1998 - before the entry into force of the law on state registration of real estate.

According to the Law, state authorities and local self-government bodies are empowered to identify right holders. As part of this work, municipalities independently analyze information in their archives, request information from tax authorities, the Russian Multifunctional Centers, internal affairs agencies, civil registry offices, notaries, etc.

In Tatarstan, between the Department of Federal service of state registration, cadastre and cartography of the Republic Tatarstan and the Government of the Republic of Tatarstan, a Roadmap was signed to fill the Unified State Register of Real Estate with the necessary information. As the Minister of Land and Property of the Republic of Tatarstan Fanil Agliullin noted, “this is a very important area, since due to the lack of information about the rights of previously recorded objects in the register, it is impossible to establish relevant and reliable information about all real estate objects located in the region. The new law allows this to be corrected, as well as to exclude from the USRN irrelevant information about previously registered real estate objects that have ceased to exist on the basis of an inspection report prepared by the local government itself.”

As part of this work, various activities are being carried out in many areas to identify copyright holders. So, for example, quite recently in the Chistopolsky district, the stage of the "People's Inventory" was completed, aimed at identifying empty, unaccounted for real estate and land plots.

Marina Iskhakova, head of the Chamber of Land and Property of the Chistopol District, said that during the People's Inventory, citizens' appeals were received about empty, improperly used facilities. For each appeal received in relation to objects that are not municipal, requests were sent to the Department of Federal service of state registration, cadastre and cartography of the Republic of Tatarstan, the department of administrative and technical inspection and the heads of rural settlements. This is done in order to establish the owner of the object and make further decisions on it. In the absence of owners of the identified real estate objects, they are recognized as municipal property, as ownerless, said Marina Iskhakova.

In turn, the Department of Federal service of state registration, cadastre and cartography of the Republic of Tatarstan recommends that residents of the republic independently apply for entering information about previously arisen rights in the Unified state register of real estate. This will not only speed up the process and reduce the burden on municipalities, but, most importantly, protect the rights of citizens from fraudulent actions with their property, and the owners themselves to freely dispose of it.

 “If the right holder is identified, the state authorities, in order to enter the relevant information into the Unified state register of real estate, send information about this to the Rosreestr of Tatarstan. However, the owners of previously recorded real estate can do this on their own. To do this, you need to apply to the Multifunctional Center with an application for entering information into the Unified state register of real estate about a previously registered real estate object and state registration of rights, attaching a document of title to the real estate object to it. At the same time, the state duty is not paid,” explained Azat Zyabbarov, head of the Department of Federal service of state registration, cadastre and cartography for the Republic of Tatarstan.

According to the Department of Federal service of state registration, cadastre and cartography of the Republic of Tatarstan, for less than a year, according to the statements of the owners, 8,355 real estate objects were registered in this way.
