The State Duma at a meeting introduced a rule establishing that personal data contained in the Unified State Register of Real Estate can be provided to third parties only with the consent of the subject of such data.
As the head of the State Duma Committee on Information Policy Alexander Khinshtein noted, the document eliminates the existing legal conflict, when the basic law "On Personal Data" establishes that only the citizen himself can dispose of them, but "the law on the state register says that the data is open to any person." Now, according to the deputy, "the citizen will have the opportunity to both open this data and close it at any time."
The initiative provides that when opening their personal data in the Unified State Register of Real Estate, a citizen simultaneously discloses information about all previous owners. According to Khinshtein, this is done in order "to be able to check the cleanliness of real estate, including when issuing a mortgage."
If the data on the owner of the real estate is closed in the Unified State Register of Real Estate, then such information can be provided only at the request of a notary acting on the basis of a written application of the person concerned in order to protect his rights and legitimate interests. The document also establishes that the cost of such a notary service, taking into account additional work, should not exceed 450 rubles.
The document also establishes that an application for registration of rights to real estate can be submitted through information channels of interaction between banks and Federal service of state registration, cadastre and cartography. A citizen will be able to apply to both the milti-functional centre and the bank in order to write an application there for the opening of his personal data in the Unified State Register of Real Estate.
