The President of the Russian Federation signed Federal Law of July 14, 2022 No. 312-ФЗ "On Amendments to the Federal Law "On Citizens' Gardening and Horticulture for Their Own Needs and on Amendments to Certain Legislative Acts of the Russian Federation" and Certain Legislative Acts of the Russian Federation"

The provisions of the law are aimed at improving the regulation of corporate and land and property relations arising from the implementation of horticulture and horticulture by citizens and provides for the improvement of the norms of the Federal Law of July 29, 2017 No. certain legislative acts of the Russian Federation”, as well as certain provisions of the Land Code of the Russian Federation, the Town Planning Code of the Russian Federation, Federal Law of October 25, 2001 “On the Enactment of the Land Code of the Russian Federation” No. 137-ФЗ.

It has been established that until March 1, 2031, members of non-profit organizations have the right to acquire ownership of a state or municipally owned garden or garden land plot free of charge without holding an auction, regardless of the date of entry into membership, if such land plot meets the established conditions in aggregate.

The amendments made to Federal Law No. 217-ФЗ established a comprehensive regulation of relations in the field of horticulture and horticulture. The concept of "the territory of gardening or horticulture by citizens for their own needs" has been clarified, and requirements for such a territory have been established; the list of issues that are mandatory indicated in the charter of the partnership has been adjusted; the list of issues that fall within the exclusive competence of the general meeting of members of the partnership has been expanded; the specifics of the decision-making of the general meeting of members of the partnership with the use of electronic or other technical means are determined; the provisions regarding the calculation of contributions were specified; specific features of the construction of capital construction facilities on garden plots are provided for; it is allowed to use garden and garden plots for growing poultry and/or rabbits by citizens for their own needs under certain conditions, conditions have been established, subject to which, at the same time, common-use property located within the boundaries of the territory of horticulture or horticulture can be transferred to the ownership of organizations engaged in gas, water, heat and electricity supply, water disposal.
