About granting the land plots in property to disabled citizens

       In connection with the become frequent addresses of the citizens having disability with statements for granting the land plots in property free of charge or on favorable terms Ministry of Land and Property Relations of the Republic of Tatarstan reports the following.

       According to article 17 of the Federal law of 24.11.1995 No. 181-FZ "About social protection of disabled people in the Russian Federation" (further – the Federal law No. 181-FZ) is provided the right of the disabled people and families incorporating disabled people for prime receiving the land plots for individual housing construction, maintaining subsidiary, country farm and gardening.

       However, the Federal law No. 181-FZ does not establish possibility of acquisition by disabled people of the land plots free of charge; thus, granting is carried out without holding the auction at market value.

       According to the explanations made in the letter of the Ministry of Economic Development of the Russian Federation of 27.06.2011 No. OG-D23-198 for prime receiving the land plot the disabled person has to consist on the account as needing improvement of living conditions.

       The resolution of the government of the Russian Federation No. 901 approved of 27.07.1996 Rules of granting privileges to the disabled people and families having disabled children on providing them by premises, payment of housing and utilities owing to which item 17 disabled people and the families incorporating disabled people are provided in a prime order with the land plots for individual housing construction, maintaining subsidiary and country farm and gardening on the basis of the statement and the copy of the reference confirming the fact of establishment of the disability which is given out by establishment of public service of medico-social examination attached to it, submitted in accordance with the established procedure to local governments.

       The disabled person has the right to apply for prime granting the land plot for individual housing construction in a place of the registration.

       According to the Federal law of 25.10.2001 No. 137-FZ "About introduction of the Land code of the Russian Federation" the order the land plots the state ownership on which is not differentiated, is carried out by local governments.

       Due to the above citizens having disability it is necessary to address to local governments in a place of continuous accommodation (registration) for registration as needing, further with the statement for prime acquisition of the land plot.
