About the Order of determination of the price of the land plots which are in property of the Republic of Tatarstan, or the land plots the state property on which isn't differentiated which sale is carried out without tendering

       The resolution of the Cabinet of the Republic of Tatarstan of 11th of June, 2015 No. 432 "About the statement of the Order of determination of the price of the land plots which are in property of the Republic of Tatarstan, or the land plots the state property on which isn't differentiated which sale is carried out without tendering" approved the price of sale of such land plots for implementation of point 2 of article 39.3 and article 39.4 of the Land code of the Russian Federation.

       According to this order sale is carried out at the price equal to market value, but not exceeding cadastral cost :

1) the land plots formed of the land plot provided in rent for complex development of the territory, to the person with whom according to the Town-planning code of the Russian Federation the contract on complex development of the territory is signed;

2) the land plots formed of the land plot provided to the non-profit organization created by citizens for complex development of the territory for individual housing construction (except for the land plots carried to public property), to members of this non-profit organization or if it is provided by the solution of general meeting of members of this non-profit organization, this non-profit organization;

 

3) the land plots formed of the land plot provided to the non-profit organization created by citizens for conducting gardening, truck farming, country economy (except for the land plots carried to public property), to members of this non-profit organization;

 

4) the land plots which are in continuous (termless) use of legal entities, to the specified legal entities except for the persons specified in point 2 of article 39.9 of the Land code of the Russian Federation (in case of absence on these land plots of buildings, constructions);

 

5) the land plots intended for maintaining agricultural production and leased to the citizen or the legal entity, this citizen or this legal entity after three years from the moment of the conclusion of the lease contract with this citizen or this legal entity or transfer of rights and obligations for the lease contract of the land plot to this citizen or this legal entity on condition of appropriate use of such land plot in case this citizen or this legal entity the application for the conclusion of the contract of purchase and sale of such land plot without tendering is submitted about day of the expiration of the specified lease contract of the land plot;

 

6) the land plots to citizens for individual housing construction, maintaining personal subsidiary farm in borders of the settlement, gardening, country economy, to citizens or country (farmer) households for implementation of its activity by country (farmer) household according to article 39.18 of the Land code of the Russian Federation.

 

Sale is carried out  at the price equal to fifteen percent from the cadastral cost of the land plot :

 

1) the land plots formed as a result of the section of the land plot provided to the non-profit organization created by citizens, for complex development of the territory for individual housing construction and belonging to public property, this non-profit organization;

 

2) the land plots formed as a result of the section of the land plot provided to the legal entity for maintaining country economy and being the property of general use, the specified legal entity.

 

       For the state support of the citizens and legal entities getting the land plots which are in public property for the general needs of the non-profit organization created by citizens for complex development of the territory for individual housing construction and the legal entity for maintaining country economy Order established the price of 15 percent from the cadastral cost of the land plot .

 

       It is necessary to consider that the price of sale of the land plots according to subparagraph 6 of point 2 of article 39.3 of the Land code of the Russian Federation (sale of the land plots on which buildings  and constructions are located , to owners of such buildings, constructions or rooms) is defined according to the resolution of the Cabinet of the Republic of Tatarstan of 03.10.2012 No. 827 "About sale of the land plots which are in property of the Republic of Tatarstan or the state property on which isn't differentiated, alienated to owners of the buildings,structures, constructions located on them"
