Changes in the Land Code of the Republic of Tatarstan

In the aim of implementation of certain provisions of the Federal Law from June 23, 2014 № 171-FZ "On Amendments to the Land Code of the Russian Federation and Certain Legislative Acts Russian Federation" changes to the Land Code of the Republic of Tatarstan were made by the Law of the Republic of Tatarstan from May 7, 2016 № 32-ZRT "On Amendments to the Land Code of the Republic of Tatarstan"

In order to bring the Land Code of the Republic of Tatarstan (h.a. LC RT) in accordance with he Land Code of the Russian Federation (h.a. LC RF) a number of norms of Articles 32, 331 and 34 LC RT are invalidated.

In order to consolidate specialists of public sector to work in the municipal districts of the Republic of Tatarstan, paragraph 1 of Article 21 of LC RT supplemented by subparagraph 11, which establishes that the land owned by the state or municipal property, can be provided for free use for individual housing construction or ancillary economy to citizens working at the main place of work in urban and rural settlements, municipal districts in positions of health professionals, education and agriculture. This provision is included, taking into account proposals from local governments.

The bill also amends the articles 10, 11, 18, 20, 21, 25, 44 LC RT, as well as other articles, resulting in norms LC RT in accordance with the new regulations of LC RF, introduced by the Law № 171-FZ, both in terms of terminology, and in terms of the innovations of this law.

In order to ensure the empowerment of provision of land plots to large families, living in urban districts, paragraph 3 of Article 32 and paragraphs 5, 8, Article 321 of LC RT are amended too. These changes extended list of land plots that can be granted to large families, residing in the urban districts, which included federal land in respect of which the Republic of Tatarstan empowered by their orders.

Additions to the article 321 of LC RT also states that the procedure for interaction of the authorized body of executive power and local authorities of urban districts in the provision of land plots in accordance with paragraph 5 of this Article shall be approved by the Cabinet of the Republic of Tatarstan.

The Act also makes editorial changes in the LC RT associated with the adoption of the Federal Law from December 31, 2014 № 499-FZ "On Amendments to the Land Code of the Russian Federation and Certain Legislative Acts of the Russian Federation" regarding seizure of land for public needs.
