Constitutional Court of the Russian Federation allowed the municipalities to "bullish" the cadastral value

07.05.2016 Constitutional Court of the Russian Federation admitted that the first part of Article 24.18 of the Federal Law dated 29.07.1998 N 135-FZ (as amended on 06.02.2016.) "On appraisal activities in the Russian Federation" (hereinafter - the Law on Appraisal Activity) do not correspond to the Constitution of the Russian Federation, to the extent to which it does not provide the possibility of the municipality to fully substantiate its case in the Commission for disputes on the results of determination of the cadastral value of land and not allow it to challenge the findings in court.

      The Constitutional Court noted that "the impugned norm is intended to balance the interests of the public authorities and tax payers. If a municipality had the opportunity to challenge any decision on the definition of the cadastral value in the amount of the market, this ratio would have been violated. "
