On January 1, 2017 shall come into force Federal law dated 03.07.2016 № 237-FZ "On state cadastral valuation" (hereinafter - the Federal Law), which establishes a new procedure for state cadastral valuation.
The authority for the state cadastral valuation now endowed to public institutions of the Russian Federation, which will operate on a continuous basis, providing continuous support of the determination of the cadastral value of the respective subject of the Russian Federation (hereinafter - public institutions). The right for decision to hold the state cadastral valuation retained by the authorities of the Russian Federation authorized to conduct it.
Federal law provides that public institutions will be carried out:
preparation for the determination of the cadastral value, together with public authorities, local governments and rights holders;
directly determining the cadastral value;
providing detailed explanations of the Implemented determining of the cadastral value;
correction of errors;
the accumulation of information about the real estate market and about the objects of real estate, together with public authorities, local authorities and owners.
It is envisaged that budget institution and its employees have disciplinary, administrative and financial responsibility for the results of determination of the cadastral value.
Federal law prescribes to place a draft report on the results of the state cadastral valuation which contains the preliminary results of the determination of the cadastral value on the Internet for 60 days, for public inspection and the possibility of submitting comments to all stakeholders and to inform the public about the conduction of state cadastral valuation.
If the error, made in determining the cadastral value, has not been corrected at the stage of placing the project report, the Federal law provides for the possibility of its correction by contacting to budgetary institution.
Federal law provides the possibility of contesting the cadastral value by its definition in the market value created by the decision of Commission for disputes on the results of determination of the cadastral value or in the court.
This provides a federal state supervision over compliance with the order of the state cadastral valuation, including the periodicity of its implementation, as well as the methodology for determining the cadastral value.
