On July 4, 2016 (with the exception of certain provisions) entered into force the Federal Law dated 03.07.2016 "On Amendments to the Federal Law "On the development of small and medium enterprises in the Russian Federation" and Certain Legislative Acts of the Russian Federation. "

Changes of the Federal law "On the development of small and medium enterprises in the Russian Federation" and other federal laws are aimed at creating a national system of guarantee institutions, a unified register of infrastructure to support small and medium-sized businesses, as well as to clarify the powers of guarantee organizations.

According to the federal law support of small and medium-sized businesses may be provided by subsidiaries of the joint-stock company "Federal Corporation for the development of small and medium-sized businesses."

Federal law specifies the conditions to organizations to small and medium-sized businesses. In particular, the possibility of referring business entities to them, if shareholders: the Russian Federation, subjects of the Russian Federation, municipalities, public and religious organizations (associations), charities and other funds (excluding investment funds) own no more than 25 percent of the voting shares of the society, and the shareholders - foreign legal entities and (or) legal entities which are not subjects of small and medium-sized businesses, own no more than 49 percent of voting shares of the company.

Federal law provides for conducting registers of small and medium-sized enterprises - recipients of support and defines the requirements for keeping such registers by the joint-stock company "Federal Corporation for the Development of Small and Medium Enterprises", its subsidiaries and organizations forming the infrastructure of support to small and medium-sized enterprises,. In addition, it sets the requirements for regional guarantee institutions.

Clarify the role of the title joint stock company, including providing those the possibility of organizing and holding, in the manner established by the authorized federal executive body, assessing of compliance of the regional guarantee institutions to the requirements of the Russian Federation, as well as the opportunity to appeal to the authorized body in the case of non-compliance of organizations to such requirements.

Federal law makes changes to the Forest Code of the Russian Federation, the Federal Law "On Protection of Consumer Rights", Federal Law "On state registration of rights to immovable property and transactions with it", "On State Real Estate Cadastre", "On state registration of real estate" and a number of other federal laws.

Article 1 of the Federal Law amending Art. 18 of the Federal Law dated 03.07.2016 № 265-FZ "On Amendments to the Federal Law" On the development of small and medium enterprises in the Russian Federation ", it is established that the size of a reduced rents under the contracts in respect of the property, included in the lists, determined by regulation legal acts of the Russian Federation.

In connection with the acceptance of the Law, there is a need to bring the provisions of the Law of the Republic of Tatarstan dated 21.01.2010 № 7-ZRT "About development of small and medium enterprises in the Republic of Tatarstan" in conformity with the provisions of the federal legislation.
