The federal law dated 23.06.2016 № 193-FZ «About introduction of amendments to article 7 of the Federal law «About Introduction of Amendments to the Federal Law «About Assistance to Development of Housing Construction» and Separate Legal Acts of the Russian Federation»

Since June 23, 2016 the Federal law of 23.06.2016 No. 193-FZ «About introduction of amendments to article 7 of the Federal law «About Introduction of Amendments to the Federal Law «About Assistance to Development of Housing Construction» and Separate Legal Acts of the Russian Federation» came into force (further – the Federal law).

The federal law establishes the right of lessees to redeem the parcels of land which are transferred to them according to the Federal law «About Assistance to Development of Housing Construction» for construction of facilities of the construction materials intended for production, products, designs for the purposes of housing construction, creation of industrial parks, science and technology parks, business incubators, infrastructure facilities, other construction, and also for their complex development, at the prices determined in lease contracts provided that lessees have no rent receivable and (or) to penalties (penalty fee) according to lease contracts and all conditions for implementation of such right provided by lease contracts are satisfied them.

Besides, in the Federal law conditions of renewal of lease contracts of the parcels of land for their complex development are established if the lessee of the parcel of land continues to use it after lease contract term in the absence of objections from the lessor and also if the lessee of the parcel of land got permission to commissioning of a capital construction project which construction was performed in accordance with the terms the specified agreement.
