The citizens even more often began to address to Management of the Federal Registration Service in the Republlic of Tatarstan asking how to refuse a real estate object, in particular, of the parcel of land, the tax by which this year considerably grew? Let's remind, the Republic of Tatarstan was included into a number of 28 pilot regions where since 2016 the property tax is calculated not on inventory as there was it earlier, and on the cadastral project cost of the real estate.
As the head of department of registration of the rights of physical persons of Management of the Federal Registration Service in the Republic of Tatarstan Endzhe Mukhametgaliyeva explained, really, the legislation provided a possibility of disclaimer on the parcel of land. Such procedure is stated in the Land code of the Russian Federation and in the Federal law "About the State Registration of the Rights to Real Estate and Transactions with It".
To refuse the property right to the parcel of land, it is necessary to file the corresponding petition in Management of the Federal Registration Service in the Republic of Tatarstan. If the right of the applicant wasn't registered in the Unified State Register of Rights, then it will be necessary to attach the document establishing or certificating the right to the parcel of land or a land share.
After consideration of such statement by the registrar the decision on the state registration of the termination of the right is made. From this day the property right of the applicant to the parcel of land is considered stopped, and the earth passes to the state.
The land code of the Russian Federation provided also disclaimer of fixed (termless) use or right of lifetime inheritable possession by the parcel of land. In this case the declaration of abandonment is submitted not to Management of the Federal Registration Service in the Republic of Tatarstan, and to executive body of the government or local government body in the location of the parcel of land which will make the decision on the termination of the right.
It is also worth noting that the above-stated order of disclaimer on the parcel of land will remain also after enforcement of the Federal law "About the State Registration of the Real Estate", i.e. after January 1, 2017. So there is time to think and not to make hasty decisions.
