About an obligatory qualification examination for appraisers of the Russian Federation
According to NP «Union of Appraisers of the Republic of Tatarstan» we inform appraising society and customers of appraising the following:
From 01.07.2017 provisions of articles 21.1, 21.2, 24 of the Federal law from 29.07.1998 N 135-FZ "About appraisal activity in the Russian Federation" (further - 135-FZ) in the new edition, providing that implementation of appraisal activity and membership in SRO of appraisers, is possible, only, in the presence of the qualification certificate and passing a qualification examination have come into force. The appraisers who are members of SRO to 01.01.2017 are obliged to pass a qualification examination till 01.04.2018, and appraisers who have entered SRO after 01.01.2017 - had to hand over him, since 01.07.2017. Further, the appraiser within each three calendar years since the year following after a year of obtaining the qualification certificate is obliged to confirm qualification by passing a qualification examination.
Thus, to 01.04.2018, at implementation of the government (municipal) procurement, signing of the contracts with appraisers - natural persons it is necessary to consider existence of the qualification certificate for the persons who have entered SRO after 01.01.2017, and after 01.04.2018 - presence of qualification certificates at all appraisers. At implementation of municipal purchases, signing of the contracts with the appraisal organizations it is necessary to check compliance of the contractor to requirements of Art. 15.1 of 135-FZ, in particular, existence in staff of two, legitimately acting, according to the above, appraisers.
Also, for improvement of quality of appraisal in municipal districts, we remind of an opportunity for reviewing by Expert and consulting council of NP Union of Appraisers of the Republic of Tatarstan of reports on appraisal on a grant basis preliminary, before coordination, signing of the acceptance report, the direction by state agencies, including Chambers (Managements) of land and property of municipal districts. Especially this reviewing is relevant taking into account cancellation of regulations on examination of SRO with 01.07.2017 and requirements of article 16.2 of 135-FZ.
According to the order of the Ministry of Economic Development of the Russian Federation from 19.05.2017 No. 240 powers of the body authorized for holding a qualification examination in the field of appraisal activity are delegated to federal budgetary institution "Federal Resource Center for the Organization of Management Training" (FRTs). Holding examinations is planned in Moscow.
The Ministry of land and property of the Republic of Tatarstan, together with NP Union of Appraisers of the Republic of Tatarstan, is initiated a number of the measures directed to holding examination in the territory of the Republic of Tatarstan. This position is supported by the leaders of the republic. The intention to pass a qualification examination in the Republic of Tatarstan in the preliminary application on the website of the Federal resource center was confirmed already by more than 170 appraisers from more, than 50 appraisal organizations and business owners.. Also, the staff of the organizations of NP Union of Appraisers of the Republic of Tatarstab gratuitously will pass as the profound program, and the target coach-intensive of preparation for examination.
Legislation innovations and also questions of application of the actualized monitoring, will be considered at seminars with experts of Chambers and Managements of land and property of municipal districts of the Republic of Tatarstan and key customers of appraisal in the nearest future.
