The experts of the Federal Cadastral Chamber have prepared instructions on coordinating the boundaries of the plots with neighbors in order to avoid land disputes. It notes that the recommendations are made as an explanation of the amendments to the laws “On Cadastral Activities” and “On State Registration of Real Estate” signed in June.

The instructions indicate that to establish the boundaries of the plots, the owner must contact the cadastral engineer, who will carry out the procedure for coordinating the borders individually with all neighbors or at their general meeting. After that, the specialist draws up an act of approval, the document is certified by the signatures of interested parties.

If the owners do not agree with the location of adjacent borders and cannot resolve the dispute with their neighbors, then they must submit written objections to the cadastral engineer. “The legislation does not give the cadastral engineer the right to resolve land disputes, therefore, if there are reasonable objections, the registration authority will suspend registration and registration actions, and the neighbors will have to resolve disagreements in court,” said Marina Semenova, deputy head of the Cadastral Chamber.

The chamber emphasized that all interested parties should be notified of the place and time of the meeting 30 days before the expected date of approval. If the engineer could not find the postal or email address of the owner, then the notice will be published in the local newspaper. “Despite the fact that the addressee may not read the advertisement in the newspaper, it will be considered duly notified,” the department emphasized. If the owner does not appear at the meeting, then it is considered that he agrees with the boundaries of the site.

On June 17, 2019, President of the Russian Federation Vladimir Putin signed the Federal Law On Introducing Amendments to the Federal Law On Cadastral Activities and the Federal Law On State Registration of Real Estate.

The law obliges to coordinate the location of borders with citizens who have adjacent sections. It should be noted that cadastral engineers specified by federal law, when establishing boundaries, are given the right to request information from the Unified State Real Estate Cadastre that is necessary for geodetic and cadastral work, including information about the addresses of property owners: postal and electronic. Access to relevant and reliable contacts from the real estate register will reduce the likelihood of targeted errors when sending citizens notifications about the coordination of the borders of adjacent plots. Timely feedback will allow you to take into account the interests of all interested parties, which means to prevent land disputes between neighbors in the future.

On August 28, 2019 the meeting of the board “On the results of the work of the Ministry of Land and Property of the Republic of Tatarstan and the Chambers (Administrations, Committee) of property and land relations of municipalities of the Republic of Tatarstan in the first half of 2019” was held under the chairmanship of Minister Azat Khamaev.

At the board meeting, the issues of profitability from managing state and municipal property, providing land to large families, designing hydraulic structures and land under cemeteries, expert support for valuation activities in the state and municipal property management sector, changes in legislation in the field of land and property relations were considered.

Speakers at the board meeting were: Deputy Ministers Eduard Diyarov, Rustem Shameyev, First Deputy Minister Arthur Galiev, Executive Director of the NP Union of Appraisers of the Republic of Tatarstan Oleg Bulgakov, Head of the Legal Department of the Ministry Zulfat Galyautdinov.
