Changes in a part of simplification of placement of linear objects are made to the Land code

On July 26, 2018 the State Duma has adopted the Federal law of August 3, 2018 N 341-F3 "About introduction of amendments to the Land code of the Russian Federation and separate acts of the Russian Federation regarding simplification of placement of linear objects" (further – the law).

The law makes the changes into the Land code of the Russian Federation providing the bases and an order of placement of linear objects on the land plots on the terms of a public easement.

According to the law the easement can be established by the decision of executive body of the government or local government for ensuring the state or municipal needs and also needs of local population without seizure of land (a public easement).

Paragraph 15 of article 1 of the law is supplemented the Land code of the Russian Federation with chapter V.7 "Establishment of a public easement in the separate purposes".

This chapter is defined the purposes and conditions of establishment of a public easement. The bodies making the decision on establishment of a public easement and also the faces having the right to petition for establishment of a public easement are defined.

Establishment of a public easement is carried out irrespective of form of ownership on the land plot. It is defined that establishment of a public easement, concerning the land plots provided or belonging to citizens and intended for individual housing construction, conducting gardening, truck farming, personal subsidiary farm except for cases isn't allowed if it is required for connection (technological accession) of buildings, the constructions located in borders of an element of planning structure in which borders there are such land plots, to networks of technical providing, operation, reconstruction of the existing engineering constructions, placements of engineering constructions which are transferred from the land plots withdrawn for the state or municipal needs.

The law comes into a force since September 1, 2018.
