The Federal Law of November 28, 2018 N 451-FZ “On Amendments to Certain Legislative Acts of the Russian Federation” (hereinafter - the Law) is aimed at improving the judicial system.
The law was adopted by the State Duma on November 20, 2018 and approved by the Federation Council on November 23, 2018.
A number of federal laws, such as the Arbitration Procedure Code, the Civil Procedure Code, the Code of Administrative Procedure, “On the Magistrates in the Russian Federation”, “On the Arbitration Courts in the Russian Federation”, “On Enforcement Proceedings” and some others, have been amended.
Changes in legislative acts are made in connection with the adoption of the Federal Constitutional Law of July 29, 2018 No. 1-FKZ “On Amendments to the Federal Constitutional Law“ On the Judicial System of the Russian Federation ”and certain federal constitutional laws in connection with the creation of cassation courts of general jurisdiction and Court of Appeal of General Jurisdiction "(hereinafter - Law No. 1-FKZ).
These changes concern the powers of the appeals instances of the courts of general jurisdiction, appeals procedures and the consideration of cases in established cassation and appellate courts of general jurisdiction, the procedure for consideration of cases in the Supreme Court as a cassation and supervisory instance.
For representatives of the parties in court in the conduct of civil and arbitration cases, a requirement for higher legal education is introduced. This requirement does not apply to civil cases considered by magistrates and district courts.
In accordance with Law No. 1-FKZ, the cassation courts of general jurisdiction and appellate courts of general jurisdiction are considered to be formed from the date of appointment to at least one second of the established number of judges of the relevant court. notify on this no later than October 1, 2019.
