The law regulating certain issues of management of horticultural and vegetable gardening partnerships is signed
Federal Law of May 25, 2020 No. 162-ФЗ “On Amending the Federal Law“ On Citizens' Gardening and Horticulture for Their Own Needs and on Amending Certain Legislative Acts of the Russian Federation ”and Article 42 of the Federal Law“ On State Registration of Real Estate ”are regulated individual issues regarding the management of horticultural and vegetable garden nonprofit partnerships.
In accordance with the Federal Law, the exclusive competence of the general meeting of partnership members includes the adoption of a decision on the application for state registration of rights to real estate located within the boundaries of the territory of citizenship of gardening or gardening for their own needs and which are public property, and (or) an application on state cadastral registration of such real estate objects. At the same time, at the general meeting, a representative is elected who is authorized to submit the corresponding application to the body conducting state cadastral registration and state registration of rights.
The Federal Law also introduces corresponding amendments to the Federal Law “On State Registration of Real Estate”.
