On October 15, 2020, President of the Russian Federation Vladimir Putin signed the Federal Law On Amending Article 23.21 of the Code of Administrative Offenses of the Russian Federation.
The specified law specifies the range of officials of bodies exercising state land supervision, authorized to consider cases of administrative offenses.
From the moment the federal law enters into force, the right to consider cases of administrative offenses specified in Article 23.21 of the Code of Administrative Offenses of the Russian Federation is vested in officials of bodies exercising state land supervision (with the exception of the body exercising state land supervision in relation to agricultural land, turnover which are regulated by the Federal Law of July 24, 2002 No. 101-ФЗ "On the turnover of agricultural land").
The introduction of these changes is due to the fact that the wording of Article 23.21 of the Code of Administrative Offenses of the Russian Federation did not meet the criteria of formal certainty and unambiguity of a legal norm. According to this article, the listed in it the elements of administrative offenses were considered "by the bodies exercising state land supervision (with the exception of state land supervision on agricultural land)." This led to the fact that the powers to consider certain elements of administrative offenses, if they were committed on agricultural land, could not be exercised by any of the state land supervision bodies.
