In the first reading and as a whole, today at the meeting of the State Council, a draft law on the regulation of certain issues related to the acquisition of citizens' rights to garages and land plots on which they are located was adopted. The same bill introduced amendments to article 3 of the Land Code of the Republic. The bill, introduced by deputies Azat Khamaev and Takhir Khadeev, was sent for signing to the President of Tatarstan.
Azat Khamaev, Chairman of the Committee on Ecology, Nature Management, Agroindustrial and Food Policy, noted that the bill was developed in connection with the need to bring the republican legislation in line with the federal one.
The bill is being adopted within the framework of the "garage amnesty". However, if the law on "garage amnesty" refers to capital buildings, then the draft law considered today concerns non-capital buildings (garages without foundations, shells, etc.) and parking spaces for disabled people. How will the assistance be expressed? Representatives of the municipal authorities will tell the owners of garages about their right to register the ownership of the garage and the land under it, if necessary, they will help with the search for title documents in the archives, and inform about the procedure for registration.
“According to Part 3 of Article 18 of the Federal Law, local self-government bodies of settlements, urban districts or municipal districts have the right to take measures aimed at identifying persons using garages located within the boundaries of the respective municipalities, the rights to which are not registered in the Unified State Register of Real Estate, and to provide assistance citizens in the acquisition of rights to them and to the land plots on which the garages are located, - explained Azat Khamaev, - the composition of these measures and the procedure for their implementation are established by the laws of the constituent entities of the Russian Federation. Measures aimed at identifying these persons and assisting citizens in acquiring rights to garages and land plots on which they are located are entitled to be carried out by local self-government bodies of municipal districts. These powers are reflected in the bill. "
In addition, the bill provides for amendments to the Land Code of the Republic. The Cabinet of Ministers is empowered to determine the procedure for approval by local self-government bodies of schemes for the placement of garages that are non-capital structures, and parking of technical or other vehicles for people with disabilities near their place of residence. The Cabinet also approves the procedure for determining payment for the use of land or land plots owned by the Republic of Tatarstan, lands or land plots, state ownership of which is not delimited, for the construction of garages by citizens, which are non-capital structures.
