In relation to a land plot, one or more main, conditionally permitted or auxiliary types of permitted use may be established

On January 10, 2022, Federal Law No. 493-ФЗ dated December 30, 2021 «On Amendments to Article 7 of the Land Code of the Russian Federation and Article 8 of the Federal Law "On State Registration of Real Estate» came into force.

According to the law, one or more main, conditionally permitted or auxiliary types of permitted use may be established in relation to a land plot.

It is envisaged that the main or conditionally permitted type of use is considered to be the chosen owner of the land plot from the date of entering information about the corresponding type of permitted use in the Unified state register of real estate. It is not required to enter information on auxiliary types of permitted use of the land plot into the Unified state register of real estate.

If there is no information in the Unified state register of real estate about the type of permitted use of the land plot, the type of permitted use specified in the title and (or) title document for this land plot, issued before the entry into force of the Federal Law «On State Registration of Rights to Real Estate and Transactions with him.»
