"Dacha amnesty" extended until March 1, 2031

On December 30, 2021, the President of the Russian Federation signed Federal Law No. 478-ФЗ “On Amendments to Certain Legislative Acts of the Russian Federation”

The law is aimed at simplifying the procedure for acquiring and registering the rights of citizens to residential buildings built before the entry into force of the Town Planning Code of the Russian Federation, in respect of which there are no title documents, as well as documents on land rights; newly built residential and garden houses; land plots provided to citizens before the entry into force of the Land Code of the Russian Federation, land plots on which apartment buildings are located. The envisaged procedure will create simpler and more convenient conditions for citizens to register rights to real estate.

In particular, it is provided that until March 1, 2031, a citizen who uses for permanent residence a residential building erected before May 14, 1998, which is located within the boundaries of a settlement and the right of ownership to which a citizen and other persons do not have, has the right to provide the ownership of the free state or municipally owned land plot on which this residential building is located. At the same time, the formation of a land plot on which such a house is located, from lands or land plots that are in state or municipal ownership, can be carried out on the basis of the layout of the land plot.

The federal law establishes a list of documents that are attached to an application for preliminary approval of the provision of such a land plot, the procedure for the authorized executive body or local government to take a decision on preliminary approval of its provision or refusal to agree.

According to the Federal Law, state registration of the right of ownership to the land plot on which the specified residential building is located is carried out simultaneously with the state cadastral registration of this house and the state registration of the citizen's ownership of the residential building at the request of the state authority or local government that provided the citizen with such a land plot .
