On January 1, 2023, amendments to the Federal Law “On the turnover of agricultural land” came into force. According to the provisions of the law, citizens or peasant (farm) farms can acquire an agricultural land plot, which is in state or municipal ownership, on lease without holding an auction for a period of 5 years, for the peasant (farm) farm to carry out its activities.
At the same time, confirmation that a citizen or a peasant (farm) economy does not have a land plot in the territories of other constituent entities of the Russian Federation is not required.
The law establishes a ban on changing the designated purpose of the provided land plot, as well as on subleasing the leased land plot and making transactions with lease rights.
The norms of the law apply if the provided land plot has the category of "agricultural land". If the land plot is located within the boundaries of a settlement, citizens or peasant (farmer) households acquire a land plot in accordance with the provisions of Art. 39.18 of the Land Code of the Russian Federation.
