The bill of modification in 135-FZ "About estimated activity"

       The bill of modification in 135-FZ "About estimated activity", accepted by the State Duma of the Russian Federation in the third reading, is approved by the Federation Council and sent to 9.07.2014 Russian President. 

      The federal law is directed on improvement of regulation of estimated activity, activity of the self-regulating organizations of appraisers and the state cadastral assessment.

       For this purpose the Federal law specifies the bases for implementation of estimated activity and a condition of its implementation, requirements to the contract for carrying out a grade, contents of the report on an assessment of object of an assessment are concretized, duties of the appraiser and the legal entity with whom the appraiser signed the employment contract are supplemented. The federal law changes the regulation order in area changes estimated activity and also the structure of bodies carrying out such regulation. Creation of council for estimated activity is provided at the authorized federal body which is carrying out functions on standard legal regulation of estimated activity, its functions are fixed, the structure, a decision-making order is defined.

       The self-regulation procedure in estimated activity is specified and concretized. For the purpose of improvement of procedure of the state cadastral assessment, the concept of cadastral cost, structure of the list of data which has to contain in the decision on carrying out the state assessment, an order of acceptance and publication of such decision, and also an order of consideration of disputes on results of determination of cadastral cost is specified.

      Access to the report on determination of cadastral cost and submission of remarks to it for an unlimited circle of interested persons to his statement is entered. Existence of the positive expert opinion on the report on determination of cadastral cost is obligatory for the approval of the report the customer of works on determination of cadastral cost.

      The federal law term since six months significantly increases till five years from the date of entering into the State Immovable Property Cadastre challenged results of determination of cadastral cost, during which results of definition of the cadastral costs can be challenged.
