Resolution of Cabinet of the Republic of Tatarstan of 28th of September, 2015 No. 712 "About the approval of the Order of determination of the size of a payment under the agreement on establishment of an easement concerning the land plots which are in property of the Republic of Tatarstan, and the land plots the state property on which isn't differentiated" approved an order of determination of the size of a payment for an easement

       This order extends on the land plots which are in property of the Republic of Tatarstan and the land plots the state property on which isn't delimited. The order is prepared for the purpose of implementation of article 39.25 of the Land code of the Russian Federation.

        The order provided that concerning the land plots located in the territory of the municipal districts of the Republic of Tatarstan, the payment size is determined by the agreement on establishment of an easement depending on the rent size for the land plot on which the easement extends.

       The same procedure of payments extends on the land plots located in the territory of the city districts of the Republic of Tatarstan which aren't provided to any natural or legal entities or are provided in free use.

       Calculation of the size of a rent for the specified cases is made according to the resolution of the Cabinet of the Republic of Tatarstan of 9th of February,1995 No. 74 "About a rent for the earth".

       Concerning the land plots located in the territory of the city districts of the Republic of Tatarstan and provided in continuous (termless) use, or in the lifelong inherited possession or in rent, the payment size is determined by the agreement on establishment of an easement on the basis of the report on an assessment prepared according to the Federal law No. 135-FZ "About estimated activity in the Russian Federation". It is connected with that the market value of the land plots in city districts is much higher, than the market value of the earth in municipal districts.

        The land user, the land owner, the tenant of the land plot receive the payment under the agreement on establishment of an easement

        In case the agreement on establishment of an easement is concluded with executive body of the government of the Republic of Tatarstan, the state enterprise, public institution, the payment under this agreement comes to the budget of the Republic of Tatarstan.

       In case the agreement on establishment of an easement is concluded with local government, the municipal enterprise, municipal authority, the payment under this agreement comes to the budget of the relevant municipality.
