Federal law dated 03.07.2016 № 275-FZ "On Amendments to the Federal Law"On Concession Agreements"

On January 1, 2017 shall come into force Federal law dated 03.07.2016 № 275-FZ "On Amendments to the Federal Law "On Concession Agreements" (h&a Law).

As of 1 January 2017 expands the list of objects of concession agreements.

Among them are including sites where the processing storage, disposal, decontamination, disposal of municipal solid waste, gas supply facilities, facilities of social services people, objects of municipal infrastructure and public utilities, including power supply facilities, facilities intended for lighting areas of urban and rural settlements, objects intended for land improvement.

The features of regulation of relations arising in connection with the conclusion of concession agreements for facilities heating, centralized hot and cold water supply, sewerage were identified.

So, it is established, in particular, that under the concession agreement, the object of which is the object of heating, centralized hot water system, cold water and / or wastewater, individual objects of such systems and the grantor to which acts municipality, third-party compulsory is also subject the Russian Federation, within the territory of which the property transferred to the concessionaire under the concession agreement, if the powers of the state regulation of tariffs in the field of heating, water supply and sanitation is not transferred to said municipality, in accordance with the laws of the subject of the Russian Federation.

It is also determined, in particular:

the conditions of the concession agreement, the object of which are the objects of heat supply, centralized hot water system, cold water and / or sanitation, on his part, the amount of payment of the concession agreement;

especially changes of this concession agreement, especially the tender documentation necessary for the competition for the concession agreement;

the criteria for the competition for the concession agreement;

especially the concession agreement without competition, the state registration of property rights to objects created by real estate and construction in progress, stipulated by the concession agreement.
