Federal Law No. 79-FZ of April 5, 2021 "On Amendments to Certain Legislative Acts of the Russian Federation" (hereinafter referred to as the Federal Law) establishes that, by September 1, 2026, a citizen using a garage that is an object of capital construction and erected before the date of introduction into force of the Urban Planning Code of the Russian Federation, has the right to grant free ownership of a land plot that is in state or municipal ownership, on which it is located, in particular, if the land plot for the garage was provided to a citizen or transferred to him by any organization (including with which this citizen was in labor or other relations) or otherwise allocated to him or the right to use such a land plot arose from a citizen for other reasons.

Along with this, the Federal Law determines the list of documents required to provide citizens with ownership of land plots and the grounds for refusing to provide them.

In particular, it is envisaged that the decision on the preliminary approval of the provision of a land plot or the provision of a land plot must be refused if the corresponding garage is recognized as an unauthorized building subject to demolition in a judicial or other procedure prescribed by law.

In addition, it is established that citizens using garages and garage owners have the right to use land plots intended for general use for passage and passage to garages freely and without charging a fee.

Today, a working meeting of specialists from the Ministry of Land Property of the Republic of Tatarstan with First Deputy Minister of Property of the Moscow Region Alexei Vyurkov took place at the Ministry of Land and Property of the Republic of Tatarstan under the chairmanship of Deputy Minister Rustem Shameev.

The guest was familiarized in detail with the main directions of the ministry's activities. During the meeting, an active exchange of views and experience was held in the field of managing organizations with state participation, real estate, land resources, interaction with municipalities and federal structures, organizing state property accounting, automating state property management activities and a number of other topical issues.

The meeting took place in a warm, constructive atmosphere and was fruitful for both sides.

On April 12, May 24 and 26 on favorable terms for small and medium businesses, auction tenders for the right to conclude lease agreements for property on a long-term basis and on favorable terms have been scheduled. Non-residential premises located in Kazan, Chistopol and Buinsk are on sale.

The lease is valid for 6 years. The rent is: in the first 2 years - free, in the third year of rent - 25 percent, in the fourth year of rent - 50 percent, in the fifth year of rent - 75 percent, and in the sixth and subsequent years of rent - 100 percent of the rent, established by the results of the auction for the right to conclude lease agreements.

On April 5, 2021, the President of the Republic of Tatarstan R.N.Minnikhanov signed the Law of the Republic of Tatarstan "On Amendments to Article 12 of the Land Code of the Republic of Tatarstan."

The Law of the Republic of Tatarstan was developed in connection with the adoption of the Federal Law of December 30, 2020 No. 505-ФЗ "On Amendments to the Federal Law" On Specially Protected Natural Areas "and Certain Legislative Acts of the Russian Federation" on the elimination of restrictions on the constitutional rights of citizens living within the borders specially protected natural areas, in particular, lifting the ban on the provision of land plots for gardening, truck farming, individual garage or individual housing construction within the boundaries of settlements included in specially protected natural areas.

At the same time, the types of permitted use of land plots, as well as the limiting (maximum and / or minimum) parameters of construction within the boundaries of settlements, including settlements, will continue to be determined by the regulation on the corresponding specially protected natural area.

The law brings the Land Code of the Republic of Tatarstan in line with federal legislation.

It is important to note that the adopted changes apply only to settlements, information about the boundaries of which are included in the Unified State Register of Real Estate.

Currently, there are 190 specially protected areas in the republic, of which 185 are at the republican level, 2 are at the federal level and 3 are at the municipal level. There are 259 settlements in these territories.

On April 3 and 4, 2021 , chess competitions were held on the basis of the State Autonomous Institution Republican sports school of the Olympic reserve in Chess, named after R.G Nezhmetdinov , within the framework of the Spartakiad.

The Ministry of Land and Property of the Republic of Tatarstan is represented by a team of 4 people, as required by the conditions of the competition: Ravil Khasanshin, Iskander Sabirov, Elena Klementyeva and Ninella Vafina. Competitors play according to the Swiss system in 9 rounds with a control time of 10 minutes each.

The Ministry of Land and Property of the Republic of Tatarstan announced an auction for the right to conclude lease agreements for property owned by the Republic of Tatarstan, free from the rights of third parties and intended to be provided on the right of ownership and (or) use on a long-term basis and on preferential terms to small and medium business (hereinafter referred to as SMBs) and organizations that form the infrastructure for supporting SMBs.

The term of the lease is 6 years

The rent is:

- in the first year of the lease - 0 percent;

- in the second year of the lease - 0 percent;

- in the third year of the lease - 25 percent;

- in the fourth year of the lease - 50 percent;

- in the fifth year of the lease - 75 percent;

- in the sixth and subsequent years of lease - 100 percent of the amount of the lease established based on the results of the assessment of the market value of the property lease.
