On programs of free granting of the ground areas to the citizens of the republic

       Due to the receipt of numerous questions from citizens to Ministry of Land and Property Relations of the Republic of Tatarstan about programs of free granting the ground areas for individual housing construction to citizens of the republic, reports the following.

       By point 2 of Art. 28 of the Land Code of the Russian Federation (Further – LC Russian Federation) it is provided that granting of the ground areas being in the state or municipal ownership, in property of citizens and legal entities is made for a payment.

       So, according to LC Russian Federation Art. 30 the ground areas can be provided in property or in rent at the auction (competitions, auctions) or in rent with preliminary coordination of places of placement of objects.

       Granting the ground areas in property of citizens can be made free of charge in the cases provided by LC of the Russian Federation, federal laws and laws of subjects of the Russian Federation.

       According to item 1. Art. 6.1. The law of the Republic of Tatarstan of 27.12.2004 No. 69-ZRT "On the state support of development of housing construction in the Republic of Tatarstan" for implementation in the territory of the Republic of Tatarstan of housing construction in system of a social mortgage the ground areas being in the state or municipal ownership can be provided free of charge once in property of the citizens participating in a social mortgage, realized within the Law, from among registered in a place of continuous residence in rural settlements of young specialists, workers of the budget sphere and agricultural branch for implementation of individual housing construction or maintaining personal subsidiary farm in case they signed the contracts providing investments, with the specialized organization.

       On December 26, 2011 the Law of the Republic of Tatarstan of November 18, 2011 No. 90-ZRT "On modification of the Land Code of the Republic of Tatarstan", providing free granting the ground areas to large families came into force. According to the submitted applications granting the ground areas is made within a year by local governments.

       Feature of the Republic of Tatarstan is in the matter that this law is provided the ground areas by everything to citizens who have many children without any restrictions. In other regions of Russia there are restrictions: absence in property of housing and the ground areas, existence of a constant registration over 3-5 years, needs in housing, etc.

       The ground areas are provided free of charge to the citizens who are constantly living in the territory of the Republic of Tatarstan, who have on date of filing of application about granting (transfer) to property of the ground area of three and more children, including stepsons, stepdaughters, and also adopted (adopted) and wards (concerning whom guardianship and guardianship are made termless, or before achievement of majority by them), not reached eighteen-year age.
